Climbing and active play are inherently risky activities. By purchasing, installing, and using Active Play products provided by Ako Playrooms Limited (“Ako Playrooms”), you acknowledge and accept all risk and liability upon yourself and anyone who uses the products you purchase. These risks include, but are not limited to, physical and psychological injury, property damage, or even death.

Ako Playrooms shall not be held responsible for any use or misuse of our Active Play products, including but not limited to installation, application, or general use. Customers are solely responsible for ensuring correct installation, including fixing products into studs or joists, and we strongly recommend that installation is carried out by a suitably qualified professional.

Always take proper safety precautions when using Active Play products, including supervising children, using protective surfacing or mats, and ensuring products are appropriate for the user’s age and ability. A harness, spotter, or belay system should be used when height presents a risk of injury from falling. Creating and maintaining a safe play environment is your responsibility.

While Ako Playrooms’ Active Play products are engineered and tested to meet Australian and New Zealand safety standards, this compliance does not remove your responsibility to ensure safe installation, use, and supervision at all times. Any advice or guidance provided by Ako Playrooms is general in nature and does not override your own judgment or duty of care.

Climbing and installing Active Play products may cause damage to buildings, walls, or surrounding property. Ako Playrooms shall not be held responsible for any such damage.

In no event shall Ako Playrooms be liable for any direct, indirect, incidental, punitive, or consequential damages, to property, health, or life, arising out of or connected with the use or misuse of our Active Play products.
